SAMPLE LEASE
Agreement between Robert E. Terry and (name) for
rental of furnished apartment at (address) Ithaca, New York 14850.
Rent will be $ (rental amount) due by the first day of each month. The Landlord is to pay (utilities
see apt. info on web.) cooking gas, gas heat, hot water, water and sewer.
Tenant to pay (see info from web page.) television cable, trashes
fees and telephone. -It is the tenant’s responsibility to make the contact
with utilities that they pay for to have them activated. NYSEG –
1-800-572-1111, Verizon 607-890-7100, Cable TV or Road Runner 607-272-3456.
Lease to run from (date start) and (date end). Tenant understands these terms. 1. No pets will be allowed. No removal of furniture from
furnished apartment without consent of owner. No waterbeds will be allowed. A
charge of $20 will be made for each lockout outside of office hours. (9-5 week
days). 2.
Tenants must obtain the Landlord’s written permission to assign the
lease in part, or in whole to another party (ies). When sublease does occur,
the security deposit and last month’s rent are to be adjusted internally
between original tenant and subtenant. Tenant’s account will be supplied to
tenant and sub-tenant upon written request. 3.
House rules must be followed rigidly, that is: A. Occupancy by other than the above listed tenants is
forbidden. Guests for more than 72-hour period of time must be cleared with
owner. B. Peace and quite, clean surroundings must be
maintained. Please respect the rights of your neighbors. C. Tenant agrees to keep all garbage in cans; to keep area
around cans clean. No refuse, furnishings, personal effect, or unsightly or
hazardous items of any kind shall be placed on the exterior of the premises or
on the porches or other structures pertaining to the premises. Fines levied,
as a result of willful failure by tenant/tenants to perform within the
provisions of the tag/recycling program will be the tenant/tenants
responsibility. It will be the tenant’s responsibility to purchase trash tags
for all trash that is not recyclable. D. The Landlord or his agent may enter the apartment for
the purposes of inspection, repair and maintenance of the premises, or to show
the apartment. Reasonable notice will be given if possible. E.
The Landlord shall not be liable for any loss of Tenant’s property by
theft, burglary, fire or other causes. It is recommended that Tenants purchase
a Renter’s Insurance Policy. F.
It is the responsibility of the tenant to notify the West Shore Office
of needed repairs in writing or call if an emergency 273-7368. Not to do so is
considered willful negligence. Tenants are expected to maintain the apartment
is good condition and are responsible for damages to it. F.
It is understood that roofs are never part of the apartment and may not
ever be used by tenants for any purpose whatsoever. G.
Smoke detectors are periodically checked by the City of Ithaca building
inspectors and by the landlord and
tenants when apartment lease begins. For tenant’s protection, it is
recommended that they check smoke detectors monthly. Detectors should not be disabled 4. Upon signing this lease a security deposit of $ (month’s
rent) and the last month’s rent $(month’s rent) is required. Your
deposit will be held in escrow at Merrill Lynch of Ithaca, New York. Security
deposit will be returned to tenant upon satisfactory termination of the lease.
Tenant may not use deposit as rental payment at any time. Rent is due and
payable on the first day of each month to 107 Worth Street, Ithaca, NY 14850.
A $25.00 service charge will be due for any check returned Not Sufficient Funds
or late rental payment received after the seventh day by 5PM, of each month, and a $1.00 per day for each additional day thereafter until said rent is paid in
full. If Tenant’s check is returned after the 7th day of the month
the payment shall be considered late. The returned check charge and late fee
are immediately due and payable as additional rent under the terms of this
Lease and are considered liquidated damages for Landlord’s bookkeeping
expenses. 5. Any costs related to collection for unpaid rent or
damages to the apartment, and reasonable attorney‘s fees, or any other
litigation arising from the landlord tenant relationship in the execution of
this lease are to be born by tenant. Tenants are jointly and severally
responsible for the entire execution of this lease. 6. In the event of the above named tenants failure to
abide by the terms of the lease deposit will be forfeited. If any of the terms
are not abided with, the Landlord reserves the right and privilege to give
tenants notice to vacate the apartment. 7. Any painting or alterations to the apartment are to be
cleared with Landlord. 8. Check in procedure. Call at least 24 hours in advance
and make mutually agreeable appointment for check in time. Prior to check in,
nothing is to be stored or moved into the apartment. Vacating tenants do not
have the right to grant new tenant access to apartment prior to check in. With
tenant or tenant’s agent (sublease or other representative), we will review
condition of apartment together and complete a statement of condition. Keys
will be given to tenant at this time. In the case where there are multiple
tenants, all keys will be rendered to person checking in and it will then be
their responsibility to distribute keys to any parties not present. 9. On or before October 15 we will contact you to find out
whether you wish to keep your apartment for the succeeding year. Please make
every effort to let us know by that date. Check out procedure. Call at least
24 hours in advance to make mutually agreeable appointment for check out time.
On the last day of occupancy, tenant and landlord will review condition of the
apartment. All tenants’ personal belongings must be removed from the apartment
at inspection time. Any personal property brought onto the premises which
shall not have been removed at the termination of this lease, shall be deemed
to be abandoned property and may either be retained by the Landlord as its
property, or may be disposed of by the Landlord at the tenant’s expense. At
check out time, the apartment is to be released in same condition with normal
wear and tear excepted. Lack of cleanliness or filth is never considered
normal wear and tear. Any cleaning or tenant damage will be charged for at
actual time, plus materials, plus 10%. Should tenant fail to be ready at the
mutually agreed upon check out time and additional inspections are necessary; a
$25.00 re-inspection fee will be charged. Any outstanding charges remaining
unsatisfied at the end of the lease will be deducted from your security
deposit. Keys to the apartment and mailbox must be returned, accurately
labeled, by scheduled check out time or on the last day of the lease or a
minimum deduction of $50 will be taken from the security deposit to re-key the
entire apartment. Assuming all is in order, forwarding address and keys are
given to Landlord, security deposit with interest will be refunded within 30
days. It is expressly agreed that this lease cannot be modified orally.
